Are you ready to get divorced? It can be an extremely difficult decision to make. It is especially difficult if you have children or a business together or for many other reasons. Each person’s reasons to get divorced are for them to consider and only you can make the decision. If you do not want to get divorced but have been served with a Petition for Dissolution of Marriage from a Sheriff or Process Server then you unfortunately may not have been able to make the decision, but you need to know your rights and what to do next.

There are two types of divorces, uncontested and contested. In an uncontested divorce, generally the parties can come to an agreement on all of the types of issues, including the following: alimony, custody of the children, child support and all other issues between them. With an uncontested divorce, they can generally be done in an amicable manner between the parties and rapidly within the court system. A contested divorce is when the parties have issues between them that are in dispute, and it will need to be addressed by the court or resolved during mediation. The process can be a short or very lengthy one depending upon how simple or complex the issues are to be resolved. In both types of cases there are filing fees paid to the court to begin the case.

Either way, if you want to file for divorce or have been served with papers, you should consult an attorney to know the law.
